By accessing or using Bank Statement Plus ("Service"), operated by HORCAJO INVESTMENT S.L. (CIF: B26537530), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

Bank Statement Plus provides a software-as-a-service platform that:

• Extracts transaction data from PDF bank statements and images
• Automatically categorizes transactions using AI technology
• Provides analytics and visualization of financial data
• Allows export of data to Excel, CSV, and other formats

3. Account Registration

To use certain features of the Service, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental consent
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Subscription Plans and Payments

4.1 Plans: We offer Free, Starter, Professional, and Business subscription plans with different features and limitations as described on our pricing page.

4.2 Billing: Paid subscriptions are billed monthly or annually in advance. Payments are processed securely through Stripe.

4.3 Automatic Renewal: Your subscription will automatically renew unless you cancel before the renewal date.

4.4 Cancellation: You may cancel your subscription at any time through your account settings. You will continue to have access until the end of your billing period.

4.5 Refunds: We do not provide refunds for partial months or unused portions of annual subscriptions, except as required by law.

5. Acceptable Use

You agree NOT to:

• Upload fraudulent or stolen bank statements
• Use the Service for any illegal purposes
• Attempt to bypass usage limits or restrictions
• Reverse engineer or attempt to extract source code
• Use automated tools to scrape or extract data
• Share your account credentials with others
• Interfere with the Service's security features
• Upload malware, viruses, or harmful code

6. Data Ownership and Privacy

6.1 Your Data: You retain all ownership rights to your transaction data and uploaded documents.

6.2 Privacy: We process your data in accordance with our Privacy Policy.

6.3 PDF Deletion: Bank statement PDFs are processed in real-time and deleted immediately after processing. We do not store your original documents.

7. Intellectual Property

The Service, including its software, algorithms, design, and content, is owned by HORCAJO INVESTMENT S.L. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Disclaimers

8.1 Accuracy: While we strive for high accuracy, our AI-powered categorization may not be 100% accurate. You are responsible for reviewing and verifying all extracted data.

8.2 Service Availability: We do not guarantee uninterrupted access to the Service. We may suspend or terminate access for maintenance or other reasons.

8.3 "As Is" Basis: The Service is provided "as is" without warranties of any kind, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, HORCAJO INVESTMENT S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service.

10. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Fail to pay subscription fees
• Request account deletion

Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our data retention policies.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of La Rioja, España.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
